Stay Issued for CMS Rule in 10 States

TO: FHA Member Hospital and Health System Chief Executive Officers
FROM: Mary C. Mayhew, President and CEO
SUBJECT: Stay Issued for CMS Rule in 10 States
DATE: November 29, 2021

A court has just halted the CMS vaccine mandate rule in 10 states based on a legal challenge by those states. Florida is not party to that suit. Unlike the ruling on the OSHA ETS where the court provided injunctive relief against the OSHA rule for all states, this ruling applies just to the 10 states at this time. We are reviewing the court’s ruling and will provide you with additional updates.

Sincerely,

Mary C. Mayhew
President and CEO
