Mayhew, President and CEO, FHA FROM: Cheryl Love, Chief Clinical and Patient Safety Officer SUBJECT: Update on Nurses Licensed Outside of Florida DATE: August 18, 2021 As a reminder, the Department of Health recently released an update to Section 464.022(8), of the Florida Statutes related to the process for single out of state licensed nurses. Below, we have outlined the current process: A nurse with a single out of state license may begin employment once the following have been completed: Satisfactory evidence of current licensure in another state or territory. The nurse’s licensure status can be verified in another state through Nursys at https://www.nursys.com/Default.aspx. Prospective candidates must submit proper endorsement application and fees through the Florida Department of Health, Division of Medical Quality Assurance’s online portal at https://floridasnursing.gov/licensing/licensed-practical-nurse-registered-nurse-by-endorsement/. The Florida DOH/MQA continues to make improvements to their process and can now approve endorsement applications in 1 day or less. Tips for expediting the process if you are directly recruiting single licensure “out of state” nurses: Use the Florida BON – Endorsement Checklist to help with completing the endorsement application (see attached) Submit the application online Submit fingerprints through “Livescan” provider prior to submitting the online application. Once the applicant’s out of state licensure status has been verified and Florida licensure application and fees have been acknowledged in the online portal, the applicant can begin employment for a period of up to 60 days while their background check is in process and the Florida license is pending. AHCA - Background Screenings: All screenings that are received for employment purposes in an AHCA regulated facility or for Medicaid are reviewed in accordance with Chapter 435 and section 408.809(4), Florida Statutes, and Rule 59A-35.090 in order to make an eligibility determination AHCA:Central Services: Background Screening (myflorida.com). It can take between 24 to 72 business hours for the Livescan service vendor to transmit the fingerprints to the Florida Department of Law Enforcement (FDLE) Background Screening Units average processing times for reviewing these screenings is 5 to 7 business days once the results are received from FDLE. In accordance with Chapter 435, section 408.809(4) an employer may hire an applicant that requires background screening before the screening process is completed. Below are the parameters for working prior to completion of the screening process: Can attend training and orientation No direct contact with vulnerable individuals Exhibits no behavior that would warrant denial or termination of employment Please see contacts below for any additional questions or assistance.
